Why off-payroll reform affects recruiters
Off-payroll reform was introduced in April 2021 in the private sector, shifting the responsibility of determining IR35 status from limited company contractors to medium and large size end clients. The tax liability now also sits with the fee-payer in the supply chain which, in most cases, will be the recruitment agency.
IR35 changes in legislation: the role of the recruiter
The fee-payer (in most cases the recruitment agency) is responsible for deducting and paying the relevant tax, Employer’s NI and Apprenticeship Levy to HMRC. The liability for incorrect status determinations sits with the fee-payer should HMRC successfully challenge status.
This means that a recruitment business (as the fee-payer) generally carries the most risk despite the end client being responsible for the status determination made.
This can be an intimidating risk. So in order to keep your business protected, you need insurance in place that will pay out when you need it the most.
